Yates BUS/415 April 2, 2012 Daniel Marinberg Business Law Paper In setting up a new business the first step is setting up the best business structure for the need of the business. There are many different things that need to be looked at in order to determine the correct entity that will be used. Will there be partners is a big question in this determination, another questions which is the most correct for the business legally. Another consideration needs to be the legal liability as well as the tax liabilities in considering the best choice for the entity of the business. There are four candidates for the job, two meet the requirements of having a high school diploma, and two do not. The first candidate is Eric, he has experience on the jackhammer but does not have a diploma. Another candidate Felipe also has experience, however does not meet the requirements of having a highs school diploma. The other two candidates meet the requirements of having a diploma; however both have medical conditions that will need to be taken into consideration. Some of the questions that need to be asked are, will the candidates be safe in the work environment, and are there changes that need to be made to the work environment, if so can Surebuild make these changes? Michelle is pregnant, this indicates that it is a temporary condition, where as Nick has epilepsy that is a permanent condition and could be very dangerous for Nick in the use of a jackhammer.
